A three-member panel led by Justice Biobele Georgewill has determined that the appeal against the two legislators was without valid reasons.
The Independent National Electoral Commission (INEC) announced Ndume and Lawan as the winners in their respective senatorial districts during the National Assembly elections.
Expressing dissatisfaction with this outcome, Muhammed Kumalia and the Peoples Democratic Party (PDP) contested Lawan’s election.
At the same time, Kudla Satumari and the PDP lodged a complaint against Ndume at the Benue state election tribunal.
The National and State’s Election Petition Tribunal in Borno State rejected both petitions.
Unhappy with the tribunal’s decisions, Kumalia and Satumari appealed to the Court of Appeal.
During the appeal proceedings, Yusuf Ali represented Kaka Shehu and the APC, Johnson Usman represented INEC, and Marcel Oru, all Senior Advocates of Nigeria, served as the legal representation for Mr. Ndume.
The senior lawyers argued before the court that the appeals should be dismissed due to their lack of merit.

Delivering the judgements, the Court of Appeal upheld the submissions of the senior lawyers, stating that the two appeals challenging the senators’ elections lacked merit.
The court dismissed the appeals and affirmed the elections of Misters Lawan and Ndume.
